Fix duplicate issue creation

What does this MR do and why?

Fixes duplicate issue creation when failure issue has already been commented on in the pipeline run. Also fixes specs.

Introduced by a recent update: https://gitlab.com/gitlab-org/gitlab-qa/-/merge_requests/1151 which returned false when the issue was already commented on, causing create_issue to run.
