Creating an MR shows an empty confidentiality box

I don't know if this exists in CE master, but I see this in EE master:

MRs can't be confidential, so I think this shouldn't be shown at all.

Probably exists in CE as well.

Hmm is there a variable available in HAML that lets me know if I am on an MR view or not?

If so, this should be an easy fix

I'll make the fix in CE and make an MR for EE as well.

Another issue touches the exact same area (CSS/HAML) so I will include the fix in that MR.
